PTCHOSTING TERMS AND CONDITIONS To protect the integrity of PTCHOSTING servers and network, and ultimately, in the interests of the majority of legitimate and fair-minded users, PTCHOSTING asks all users to acknowledge acceptance of the following terms and conditions before committing to purchase a service. Please note that your statutory rights are not affected PTC Hosting "PTCHOSTING" provides web hosting and email services. PTCHOSTING reserves the right to suspend or cancel any client's access to any portion or all of PTCHOSTING services, when PTCHOSTING deems that the account has been used inappropriately. PTCHOSTING reserves the right to refuse service and/or access to its servers to anyone. 1. User Policy PTCHOSTING prohibits sites engaged in Illegal activities including but not limited to storing and/or distributing illegal copies of copyrighted software, warez sites, violations of copyrights and trademarks, violations of Domestic laws, selling and/or distributing illegal contraband. Internet abuse including but not limited to spamming - mass unsolicited Emailing, distribution of mass emailing programs, cross-posting messages to a large number of usenet groups, posting obscene or inflammatory messages, threatening other Internet users, mail bombing Internet users, running packet sniffers or port scanners and spamming. Systems abuse including but not limited to use of excessive CPU resources, use of excessive disk space, use of excessive email storage space, hacking our systems, installing continuously running programs, such as IRC bots, reselling CGI scripts or web space. 2. Obscene content PTCHOSTING prohibits sites engaged in obscene content and from using PTCHOSTING's network to advertise, transmit, store, post, display, or otherwise make available child pornography or obscene content. PTCHOSTING will notify law enforcement agencies when it becomes aware of the presence of child pornography on or being transmitted through it's network.The determination of what is "obscene" and prohibited shall be solely made by PTCHOSTING. 3. Policy Violation Should a policy violation occur, PTCHOSTING reserves the right to terminate the account without notice and without any refunds. The client violating a policy will be held responsible for any damages to PTCHOSTING, including but not limited to, PTCHOSTING's system, servers, connectivity, reputation, business, service, network, operations, or equipment. The policy violator may be charged a clean up fee not exceeding $500. 4. Web Site Content PTCHOSTING will make all effort to ensure no loss of data by a policy of frequent backups (at least every 24 hours) The client is ultimately responsible for keeping a copy of their most current web site files as backup on a remote system. PTCHOSTING is not responsible for any lost files, information, or data. 5. Customer Support Support is provided via a toll free number - 1-800-342-7564. We also will provide support via online (ticket creation) & email. 6. Payment Policy The annual fee, setup & domain fee is non-refundable after the expiration of the 30 calender day guaranteed cancellation period. PTCHOSTING reserves the right to change prices at any time after the expiration of the annual subscription period by giving no less than 30 calender days prior notice. 7. Account Cancellation PTCHOSTING reserves the right to terminate service at any time. If an account is terminated for a policy violation there will be no refund. PTCHOSTING reserves the right to delete the policy violating web site content without notice. Customers can cancel service at any time. All account cancellations should be completed through the online cancelation form. PTCHOSTING is not responsible for the site being transferred to another Service Provider or Servers if an account is cancelled due to non-payment. 8. Indemnification The client agrees to defend, indemnify and hold harmless PTCHOSTING against any liabilities arising out of defective products sold to customers from PTCHOSTING servers, personal injury or property damage caused by products or services sold or distributed from PTCHOSTING servers, any material that infringes or allegedly infringes on the rights of a third party available from PTCHOSTING servers, and any material that libels or allegedly libels a third party available from PTCHOSTING servers. 9. Disclaimer PTCHOSTING is not responsible for any damages to any client's business. PTCHOSTING makes no warranties or guarantees of any kind, expressed or implied for services provided. Use of PTCHOSTING's web hosting and email service is at the client's sole risk. PTCHOSTING's services are provided on an "as is, as available" basis. PTCHOSTING does not guarantee that its services will be uninterrupted or error free. PTCHOSTING will provide every effort in good faith to ensure that its services are available to as many Internet users as possible with minimal service interruptions. In no circumstance will PTCHOSTING be liable for any claims resulting from the use or inability to use PTCHOSTING's services - including, but not limited to, service interruptions, client errors, Internet connectivity problems, miscommunication, unauthorized access to PTCHOSTING servers, InterNIC/Nominet problems, DNS caching, Internet bandwidth congestion, power failures, vandalism, and natural disasters. 10. PTCHOSTING reserves the right to revise its policies at any time. PTCHOSTING reserves the right to revise its policies at any time by giving 60 days due notice of such revision to its clients. If any such revision is unacceptable to the client, the client may, under the terms of clause 7 above, give notice to cancel the service.
